Information on the processing of personal data in connection with a visit to our website and to our social media profiles

Fractera, s.r.o., as the Controller, processes your personal data for several purposes of processing, which are set out below.

First of all, however, we would like to explain what is meant by “personal data” in the context of our company.

Personal data

Personal data are data relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Purpose of the processing of your personal data

We record and use the personal data you give us when you visit our website for the purpose of securing the proper operation, functionality and user-friendly use of our website.

IP address and other data needed to use electronic services

When you access and use our website, we collect only the personal data that your browser automatically transmits to our server. This information is temporarily stored in a log file. The following information is recorded without any action on your part and is stored until it is deleted automatically:

Your IP address: this is a number automatically assigned to a computer by the internet service provider (ISP). An IP address is above all a unique identifier of a device connected to the internet or to a local network. Put simply, it identifies a computer, a phone or a tablet, not a person. The IP address is identified and recorded automatically in our server log files whenever a user visits the site, together with the time of the visit and the pages visited.

An IP address is not always considered personal data, only where a specific person can be identified through other means available to the Controller. Static IP addresses used by natural persons, that is individuals, must be considered protected personal data. A dynamic IP address which an online service provider stores in connection with a data subject browsing the content of its website constitutes personal data for that service provider (controller) where it has legal means allowing it to identify the data subject, including with the help of additional information held by the data subject’s internet access provider. A dynamic IP address will also be considered personal data where the online service provider processes, together with the dynamic IP address, other identifiers considered personal data (for example first name, last name, e-mail and similar).

An IP address will not be considered personal data where the IP address being processed is assigned to a network used by a large number of devices, so that a specific device user cannot be identified (for example a company LAN in which hundreds of computers are networked and used by an even larger number of users), and also where the IP address is anonymised at the technically earliest possible moment, and the IP address is never written to a hard disk or virtual disk.

Your browser: certain information is collected through most browsers, for example the MAC (Media Access Control) address, the computer type (Windows or Macintosh), the screen resolution, the operating system version, and the type and version of the web browser.

Your IP address as personal data in relation to our company: we inform you that we do not have the means to identify a specific user unless that user entered further personal data when visiting our website, such as a first name and last name or contact details. Because current European case law states that a person is identifiable also where someone else (a third party) can identify the data subject through other legal means, this IP address can be considered personal data even where you provide no other personal data when visiting our website.

In cases where the IP address must be considered personal data, we inform you that the recipients of your personal data also include our processors: programmers (IT technicians), providers of computer services and of services connected with computer data processing, and also providers of web hosting and data storage services, whose current list is here. We are also obliged to provide the data to courts, law enforcement authorities, authorities hearing administrative offences and other public authorities, where they call on us to provide the data in accordance with national law or with EU law, or where we ourselves assert our claims in court proceedings.

Legal basis: Art. 6(1)(f) of the Regulation, the legitimate interest of the Controller, serves as the legal basis for the processing of personal data. Processing the data named above is necessary to provide our services and therefore serves to protect the legitimate interest of our company.

Erasure and retention period: the personal data of the data subject are erased or blocked as soon as the purpose of storing the data is fulfilled. Collecting data to operate the website and storing data in log files is absolutely necessary to administer the website. A longer storage period can apply in individual cases where the law requires it.

Cookies

What a cookie is: a cookie is a small text file which a website stores on the hard disk of your end device (for example your computer or mobile device) while you browse it. Thanks to this file, the website keeps information about your actions and preferences for a certain time (such as a login name, language, font size and other display settings). The information is sent either back to the original website or to another website (third-party cookies).

Which cookies we use: this website uses cookies to remember user settings and for the necessary functionality of the website. We also use this information to help make the website more user-friendly, to develop our site design and to improve the quality of the services we provide continuously. We also use cookies to personalise content and advertising and to analyse traffic.

Depending on the type of cookie and the browser settings, cookies can be permanent or temporary (for as long as your browser is open, or for the period set in its settings). Permanent cookies help identify a device when it visits our website and allow us to avoid showing the same content repeatedly. Temporary cookies are deleted automatically when the browser is closed.

Our company uses several types of cookie: necessary technical cookies, whose use is required for the functionality and operability of our website and which we process on the legal basis of fulfilling our legal obligation under the Act on Electronic Communications, and optional cookies, which can be processed on the basis of the consent of a visitor to our website.

The analytics and marketing tools we use

On this website we use the PostHog tool to analyse traffic and user behaviour (analytics cookies) and the Meta Pixel tool of Meta Platforms Ireland Limited to measure and personalise advertising (third-party marketing cookies). Analytics and marketing cookies are only triggered after you give consent through the cookie bar. Before consent is given, they are not triggered. Necessary technical cookies always work.

In connection with the use of the Meta Pixel tool, a transfer of personal data to the USA can take place. This transfer relies on the adequacy decision of the European Commission for the EU-US Data Privacy Framework, under which Meta Platforms Ireland Limited is certified, or on standard contractual clauses under Art. 46 of the Regulation. The PostHog tool can process data in the European Union or in the USA. In the case of a transfer outside the EU, it relies on the adequacy decision of the European Commission or on standard contractual clauses under Art. 46 of the Regulation.

How to control cookies and how to refuse their use

You can control or delete cookies as you see fit. For details, see aboutcookies.org. You can delete all cookies stored on your computer and you can set most browsers to prevent cookies from being stored. Individual cookies can also be set directly on our website. A visitor to our website sees a cookie bar on the first visit, which gives information about the types of cookie we use, and once the visitor confirms their preferences we store in the browser the information about which consents were given. By clicking the “Accept all” button, the visitor to the website consents to the use of all optional cookies, including third-party cookies. If a visitor does not want all cookies to be collected, they can choose the types of cookie (apart from the necessary technical cookies) whose use they consent to, or refuse all cookies except the necessary ones with a single button.

Identifying a specific user on the basis of cookies

The data obtained through the cookies we use on our website will not be used by us to identify a specific visitor to our website, because we do not have the means to establish which particular person uses the cookies, except where a data subject fills in a registration request or a request to conclude a contract on our website. Also, in the case of third-party cookies, it cannot be ruled out that they will be assessed as personal data (a third party, for example Meta, can hold data that make it possible to identify the data subject after matching, in which case the cookies are considered personal data).

If you find links to other websites on our site, please remember that those sites have their own way, scope and type of cookies that they use. We recommend that you read and set the cookies on those websites before you start browsing them.

Website security

We also inform you that a visit to our website is completely safe, because we use the secure HTTPS protocol, which provides secure data transmission and prevents unauthorised access. The HTTPS protocol uses standard website transmission, with the data encrypted by an SSL certificate.

Social media

Below is information on the processing of your personal data that takes place in connection with a visit to our social media profiles. When we publish content on our social media, personal data can be processed, including profiling. In addition to the PostHog analytics tools named above, we also use analytics tools from Facebook, mainly to track traffic and the performance of our advertising activity and content.

Our company operates the following social media profiles:

Our company also has posts published on YouTube.

Unless this information states otherwise below, our company is the controller within the meaning of Art. 4(7). Alongside us, however, the operator of the given social media platform is a separate controller too. That is a further independent controller carrying out processing of personal data over which we have only limited influence.

Our company processes personal data on social media pages for the purpose of raising public awareness of our company in the online environment, for the purpose of communicating with visitors to social media and answering their enquiries, where applicable within pre-contractual communication with prospective clients, and for the purpose of managing advertising campaigns. For the purpose “social media - statistical data” we act together with Facebook as joint controllers of personal data.

The legal basis is Art. 6(1)(f) of the Regulation. The legitimate interest is justified by the interest of our company in developing our public relations and in communicating with you. In the case of pre-contractual communication with prospective clients, the processing of their personal data is carried out in accordance with Art. 6(1)(b) of the Regulation.

Retention period of personal data and the criteria for determining it

All personal data you gave us in connection with a message sent through a direct private message to our social media page will be erased by us within 90 days at the latest after the final answer is sent to you. All posts and reviews you publish on our social media profile stay on the timeline for as long as our official profile on that social network is operated, unless we remove them or unless you remove the post yourself.

Facebook and Instagram

Personal data for Facebook and Instagram are processed by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (hereinafter “Facebook”), as described in the Facebook policy. In this connection we point out that user data can also be processed outside the European Union. The transfer of personal data to the USA relies on the adequacy decision of the European Commission for the EU-US Data Privacy Framework (of 10 July 2023), under which Meta is certified. Standard contractual clauses under Art. 46 of the Regulation serve as an additional safeguard.

For the purpose “social media - statistical data”, our company is a joint controller with Facebook. For this purpose, Facebook provides our company, as the owner and administrator of its official social media profiles (fan pages), with statistics and information to an extent that allows them to be considered personal data. The personal data obtained for these purposes are processed on the basis of a joint controller arrangement between our company and Facebook.

Other social media

In addition to Facebook and Instagram we have a profile on LinkedIn (operated for EU purposes by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland) and a YouTube account with Google. In this connection we point out that user data can also be processed outside the European Union.

Web tracking and the operator of the social media platform

The operator of the social media platform uses web tracking. Web tracking can be carried out independently of whether you are logged in to or registered on the social media platform. We cannot influence the web tracking methods of social media platforms and therefore cannot switch them off.

Cookies on social media

As regards the cookies used in the promotion of our company on social media and in related activities, we are obliged to inform the data subject about the use of such cookies on our profile, but we do not identify any specific person through these tools. For this purpose we use standard solutions from Meta (Facebook/Instagram) and from the other social media operators.

Common provisions on the recipients / categories of recipients of personal data (for the website and for the social media profiles)

In general we try to set up the processing of personal data so that personal data are not transferred to third countries outside the European Economic Area. However, we also use the services of some leading suppliers based outside the EU (for example in the USA), for purposes relating to our online activities on the web, in search engines and on social media. Where we transfer personal data to third countries, we do so only on the basis of an adequacy decision of the EU Commission, or we require other safeguards (for example standard contractual clauses) in accordance with Art. 46 of the Regulation.

Records of exercised rights of data subjects

If you exercise your rights as a data subject, we keep a record of it, on the basis of Art. 15, 16, 17, 18, 20, 21 and 22 of the Regulation. For this purpose we process all categories of your personal data, for a period of 5 years. This information is available only to our authorised employees who process your personal data.
